Keeping the amanah (trust) is one of the Islamic ethical principles that the Qur'an obliges to observe. A trustee is required to give back the amanah based on the conditions agreed upon. But, for example, should a person return a gun entrusted to him at a time when its owner is more likely intending to kill or harm with it?

In my opinion, the trustee should not give the gun to the owner if he knows that the owner have intention to kill or do harm with it. As a muslim, we should encourage goods and prevent evil (amr ma'ruf nahi munkar). Although the gun is amanah and should be return to the owner when he ask for it, the trustee should negotiate with the owner and wait until the owner has calm down and can think rationally. Killing is a big sin and should be avoided. The trustee can prevent harm if he does not give the gun to the owner in the wrong time.

Amanah means being honest and sincere. It is one's responsibility and trustworthiness. Amanah to fulfill one's responsibility towards his Lord as well as to human being, to be honest and sincere in doing thing, and to keep deposits properly and use them according to the terms and conditions as notified by the owner. However, regarding to this case, if we are given the amanah to keep the gun and the owner ask to return it whenever he is in need but then we know that If we return the gun when he is angry and most likely use the gun for killing, we should not return it to him. Though we may not fulfill our amanah toward the gun's owner, but we have to prevent a bigger harm (murder) that would be a result of our action for returning that gun. We know that killing is a very big sin, therefore we have to prevent and stop when we know that it would be happened. Lastly, it is better for us to read and consider thoroughly about the term and condition of amanah before we agree and sign it. Because it has substantial implication if we do not fulfill it as the way it is or we misuse/misconduct the amanah. Thus we should think first before we accept amanah that is given to us. Wa'allahualam bi shawab.

In my opinion, well, breach of trust or amanah is certainly a bad thing and a hadtih also had stated that breaching of amanah is one of the characteristics of the munafik. However in this matter, we are looking at different perspectives. Life of human is sacred for everyone who is bearing. Even oneself cannot take his or her own life and in this condition, a person wants to kill another person with his own gun. Certainly, it is unacceptable. Of course the trustee has the amanah of holding the gun for that person but that person wants to use it for killing and not for defending. That trustee has to decide and I'm agree with 2050_ria and here maybe he should be looking into a maxim which is harm should neither be inflicted nor received and go into the sub of this maxim which is the lesser of the evils is chosen. From here, we can see that harm is going to be engaged by the person which is killing however in the mean time breaching of amanah is going to happen if that trustee does not give the gun. As we all know, a life is sacred and none other people can take it except Allah. That is also an Amanah wasn't it? So by not giving the gun to the real owner, we actually had prevent more harm. First, a life has been saved, second, the real owner of the gun will not be charged and of course guilty in this matter and the circumstances is saved for another day.(",). Well, instead of giving the gun why don't the trustee give some comfort and patient to the owner. Was not our prophet teach us to be patient and protect oneself from doing harm to oneself and others? For me that is also and Amanah. Once again, do not give the gun. Wassalam. (",)

Allah has created man as khalifah. He gifted man physical and intellectual capabilities and knowledge to use in a right manner. These are given to man as an amanah. Besides, the individual’s relationship toward themselves, family, society, and humanity is also amanah.
Back to the topic, in my opinion, the trustee should not return the gun to the owner in a time the owner is intending to kill or harm with it. When we return the gun, it such encourages people to do the wrong thing. Come to this scenario, our amanah is in term of protecting and avoiding harm to one another. If we are not doing it, means we not uphold the amanah given to us wisely. For conclusion, before we do something, we should think the consequences that will happen not only toward ourselves, but also toward others and, our amanah to do amar ma’ruf nahi mungkar among the human being.

In Islam, amanah has very extensive and unlimited meaning. It can be amanah to our self, family, society, and also to other creation. It is necessary to clarify the meaning of amanah, the importance of fulfilling it and how should it practically manifest. This is because some may take it in the light manner such that it is not the centre of their attention and highest priority in their mind. As the prophet had mention about “the sign of a hypocrite are three: when he speaks he lies, when he makes a promise he breaks it, and when he is trusted he betrays.” it is noticed that some of us may not take the amanah in the manner it should be taken. On the other hand, one of the meaning of amanah is to choose right people for the right position. The responsible positions are trust and it must be handed over to right people. So related to the example, the man should not return the gun o the owner, even though he is the owner for the gun. This is because it is not a right time to him to use it because he has the intention to kill or do the wrong thing. It is not easy to carry the amanah or responsibility because what we do will be asking in the Day of Judgment. May Allah gives us courage to fulfill amanah.

No. I will not return the gun to him. What if he shoots someone? What if he shoots Ustaz Kabir??? Sad


Hmmm....but lets' say I do not care what he is going to do with the gun.

If I return the gun to him, then he kills someone with it, is it my fault?

Wait, that is not the right question.

Of course someone would go, "Mahera, it wouldn't have happened if you didn't give the gun to him. ITS ALL YOUR FAULT!!"

What I meant was, will I be comitting a sin as well?

If yes, sin for what? For killing too? Or for being irresponsible? confused

It seems that all agree that he must not return the amanah. May I look at this problem from a different perspective. May I disagree with you all due to some critical concern.
Yes, it is wrong to kill wrongfully. But if he wants the gun back for self defenses. Does he not have the right to ‘harm’ back the one who is trying to harm or kill him in the same proportion. Perhaps by arming himself with the gun, the aggressor (his opponent) will not dare to harm/kill him in fear of repercussion… (shoot me, I shoot you back in the same instance….. or else better, do not shoot/harm me so that you may also not be shot/harmed).
This scenario is similar to Weapon of Mass Destruction, particularly nuclear weapon. If two countries have nuclear, they are unlikely to engage in a direct or all out fighting, and more unlikely to use nuclear weapon. Using nuclear weapon in such a situation is just like committing suicide! Don’t you all agree?

Also imagine that if the person who gave you gun eventually died, will you not feel that you indirectly contributed to his death. Will you not feel guilty for the rest of your life that you have committed a double crime: (1) denying him the right to self defense and survival and (2) betraying his amanah.

Such questions are raised in Fiqh books by jurists and know that there is no one who will tell you yes give him his gun and let him kill someone. We should consider here the purposes of Sharia and what is called in Makasid مآلات الأفعال as a Shatibi talked about in his famous book of Makasid. Such cases and questions will open before us a great kind of deep religious knowledge. And in Shatibi's book we can find many things related to the topic of our brother.

The person should not return back the gun at that particular time even though it will be going against their agreements. This is because giving the gun to the owner at that particular time will cause more harm than not giving it him. Allah will reward that person for this act. For example Allah has ordered us to obey our parents on condition that they do not order us 2 do sins. That means we can disobey our parents when they instruct us on what is against our religion. The same applies 2 this situation.

Assalamualaikum w.b.t. I agree with you guys' opinions that the trustee should not return the gun as it may cause harm to others. But, I also agree with bro abdul who stated that the trustee should return the gun to the owner because if the gun is not return and the owner died, the trustee has violates the amanah on him. The answers to this situation are differ because it depends on opinion of individual. However, I definitely agree with bro said's opinion. His examples about we need to obey parents unless they instruct us to do sins is relevant to this case. Obey parents are our priority but if they ask us to do bad things which is not in line with Shariah, we are not allowed to follow the instructions. wallahualam~ ^^
